1. Copyright Ownership

All original photographs, images, and photographic content displayed on Gilberto A Photos are protected by applicable copyright laws and international agreements.

Unless otherwise indicated, all photographs are the intellectual property of Gilberto Alejandro González, operating under the name Gilberto A Photos.

Purchasing a digital download, commercial license, photographic print, or any other product does not transfer copyright ownership to the purchaser.

No photograph may be reproduced, distributed, sublicensed, sold, or commercially exploited except as expressly permitted by a valid license or applicable law.

2. Digital Photography Downloads and License Options

Gilberto A Photos offers digital photographs for personal and commercial use through its online galleries.

The following digital download options are available:

Personal-Use Digital Downloads

The first three options (Small Digital, Medium Digital, and Large Digital) include a limited, non-exclusive, non-transferable license for personal, non-commercial use only.

These licenses apply to the purchased photograph regardless of its size or resolution.

Purchasing a personal-use digital download does not grant commercial, advertising, publishing, or editorial usage rights.

Commercial License – Full Resolution

The fourth option, priced at $79.99, includes the highest available resolution of the selected photograph and a limited, non-exclusive commercial license.

This license permits authorized commercial and editorial use for one project or campaign, subject to the conditions and restrictions described in Section 5.

3. Permitted Personal Uses

Under the Personal Use License, purchasers may:

Download and store the purchased photograph on their personal devices.
Use the image as wallpaper on personal computers, tablets, or mobile phones.
Display the photograph privately on personal electronic devices.
Print the photograph for personal enjoyment or private home decoration.
Create personal, non-commercial prints for display in their own residence.
Maintain reasonable backup copies for personal use.

These permissions are granted only to the purchaser and do not authorize commercial exploitation or redistribution of the original digital file.

4. Prohibited Uses Under the Personal License

Unless separately authorized in writing, personal-use purchasers may not:

Sell, resell, distribute, share, or sublicense the digital photograph.
Use the photograph in advertisements, advertising campaigns, or promotional materials.
Publish the photograph in commercially distributed books, magazines, newspapers, or other publications.
Use the photograph on products intended for sale, including calendars, posters, greeting cards, merchandise, or other commercial printed products.
Upload the photograph to stock photography platforms or digital asset marketplaces.
Offer the image as a free or paid download on another website.
Claim authorship or copyright ownership of the photograph.
Remove or alter copyright notices or copyright metadata incorporated into the file.
Use the photograph to train artificial intelligence systems or include it in image-training datasets without separate written authorization.

Any use beyond the permissions granted under the Personal Use License requires prior written authorization or an appropriate commercial license from Gilberto A Photos.

Nothing in these conditions restricts uses independently permitted by applicable law.

5. Standard Commercial and Editorial License

Gilberto A Photos offers a standard commercial license through the Commercial License – Full Resolution digital download option, priced at $79.99 per photograph.

This purchase includes the photograph at its maximum available resolution and grants a limited, non-exclusive, non-transferable license for one identified commercial or editorial project or campaign.

Permitted Uses

Subject to the restrictions below, the standard commercial license may authorize:

Use of the photograph in one commercial website, promotional project, or advertising campaign.
Reproduction in books, magazines, newspapers, educational publications, or other editorial materials associated with the licensed project.
Use in presentations, reports, brochures, and promotional materials for the licensed project.
Incorporation into a documentary or audiovisual production associated with the licensed project.
Reasonable cropping, resizing, and layout adjustments necessary for the authorized project, without misrepresenting the photograph or its authorship.

The license is non-exclusive. Gilberto A Photos may continue displaying, licensing, and selling the same photograph to other customers.

The license covers one project or campaign and its associated materials. It does not authorize unrelated projects or additional independent campaigns.

The authorized project may be distributed worldwide and may remain in use without a fixed expiration date, provided its use remains within the original licensed scope.

Commercial License Restrictions

The standard commercial license does not permit:

Reselling, sublicensing, distributing, or offering the original image file as a standalone product.
Uploading the photograph to stock photography platforms or digital asset marketplaces.
Selling the photograph as an independent photographic print or as the principal artwork on merchandise intended for resale.
Creating commercial calendars, posters, greeting cards, apparel, or similar products primarily featuring the photograph for sale without additional written permission.
Using the photograph in multiple independent projects or campaigns without additional licensing.
Claiming authorship or copyright ownership of the photograph.
Removing or modifying copyright notices or metadata.
Using the photograph to train artificial intelligence systems or in training datasets without separate written authorization.
Transferring the license to another person or organization without authorization.

The purchaser may provide the photograph to designers, printers, publishers, or other contractors solely to complete the licensed project. Such parties may not retain or use the file for unrelated purposes.

Identification of the Licensed Project

The purchaser must identify and document the intended project or campaign when purchasing the license or before beginning commercial use.

If the intended use is uncertain or falls outside the permissions described above, the purchaser must contact Gilberto A Photos for written clarification or additional authorization before proceeding.

A separate license confirmation or certificate may be provided electronically when applicable.

All rights not expressly granted remain reserved to Gilberto A Photos.

6. Royalty-Free and Rights-Managed Licensing

Gilberto A Photos may offer additional customized licensing arrangements, including Royalty-Free (RF) and Rights-Managed (RM) licenses.

Royalty-Free (RF) — License Without Per-Use Royalties

A Royalty-Free license allows specified uses of a photograph under an agreed set of conditions without requiring an additional royalty payment for each authorized use.

Royalty-Free does not mean that the image is free of charge or unrestricted.

Rights-Managed (RM) — License for Defined Uses

A Rights-Managed license authorizes a specific use that may be restricted by publication type, duration, geographic territory, distribution, print quantity, or other agreed conditions.

The availability, pricing, and terms of customized RF or RM licenses are determined individually and may differ from the standard commercial download license.

Exclusive rights, specialized merchandising rights, extended usage, or other permissions beyond the standard commercial license require a separate written agreement.

7. Image Resolution and File Delivery

Digital downloads are provided in the dimensions specified for each product, subject to the maximum resolution available for the selected photograph.

Actual image dimensions may vary depending on the original photograph, cropping, and aspect ratio.

The Small Digital, Medium Digital, and Large Digital options are limited to maximum longest-side dimensions of 1800, 3600, and 5400 pixels, respectively.

The Commercial License – Full Resolution option provides the maximum available resolution through the website’s digital download system.

Full-resolution delivery does not necessarily include RAW files, layered editing files, or other original photographic materials.

The resolution of a photograph does not independently determine the rights granted. Usage rights are defined by the license associated with the purchased product.

8. Copyright Inquiries and License Requests

For additional commercial licenses, specialized editorial uses, copyright questions, or requests for special permissions, please contact Gilberto A Photos through the website’s Contact page.

When requesting additional licensing, please provide:

The title or description of the photograph.
The intended use of the image.
The type of publication, campaign, or project.
The expected distribution or number of copies, if applicable.
The requested license duration and geographic territory, if known.
Whether exclusive rights or merchandise resale rights are required.

All requests will be reviewed individually.

9. Reservation of Rights

All rights not expressly granted under these licensing conditions remain reserved to Gilberto Alejandro González / Gilberto A Photos.

Unauthorized use may result in termination of the applicable license and any remedies available under copyright law.

These licensing conditions should be read together with the website’s Terms of Sale and Privacy Policy.

Nothing in these conditions limits rights or exceptions independently provided by applicable law.
