1. General Information

These Terms of Sale govern purchases of digital photographs, commercial photography licenses, photographic prints, and other products offered through the Gilberto A Photos website.

By placing an order, customers agree to these terms, subject to any rights provided by applicable consumer protection laws.

Gilberto A Photos is operated by Gilberto Alejandro González, an independent nature photographer based in Florida, United States.

2. Products and Availability

Gilberto A Photos offers photographic products that may include:

• Digital photograph downloads for personal, non-commercial use.

• Full-resolution digital photographs with a non-exclusive commercial license.

• Fine art photographic prints and other physical products.

• Additional editorial, commercial, or specialized photography licenses arranged separately.

Product availability, sizes, materials, and pricing may change without prior notice. Changes will not affect orders already accepted.

3. Digital Photography Downloads

Digital photographs are available in four options:

Actual image dimensions depend on the original photograph, its resolution, cropping, and aspect ratio.

Personal-Use Digital Downloads

The first three options (Small Digital, Medium Digital, and Large Digital) include a limited, non-exclusive, non-transferable license for personal, non-commercial use only.

These purchases permit personal display, private printing, and other uses expressly authorized by the Personal Use License.

Purchasing these digital downloads does not transfer copyright ownership or grant commercial, advertising, or editorial usage rights.

Commercial License – Full Resolution

The fourth option, priced at $79.99, includes the highest available resolution of the selected photograph and a non-exclusive commercial license.

This license permits authorized commercial and editorial use for one project or campaign, subject to the scope, limitations, and restrictions established in the Copyright & Licensing policy.

The license does not transfer copyright ownership, grant exclusivity, or permit unrestricted redistribution, resale, sublicensing, or use of the photograph as a standalone digital product.

Uses exceeding the standard commercial license require a separate written agreement with Gilberto A Photos.

4. Ordering and Payment

All prices are listed in United States dollars (USD), unless otherwise indicated.

Orders are processed through the payment methods available at checkout.

Applicable taxes and any additional charges will be displayed during checkout when required.

Customers are responsible for providing accurate billing, contact, and delivery information.

Orders are subject to successful payment authorization and confirmation.

5. Digital Delivery

Digital products are delivered electronically through the website’s download system after successful payment processing.

Customers should download and safely store their purchased files.

Commercial license purchases include the digital photograph at its maximum available resolution, subject to the licensing conditions established in the Copyright & Licensing policy.

A separate written license confirmation or certificate may be provided electronically when applicable.

If a download link is unavailable, a file is damaged, or a technical problem prevents access to a purchased photograph, customers should contact Gilberto A Photos for assistance.

Gilberto A Photos will make reasonable efforts to resolve delivery problems or provide an appropriate remedy.

6. Digital Product Refunds

Because digital photographs are delivered electronically, completed downloads are generally not eligible for refunds based solely on a change of mind, except where applicable law requires otherwise.

If a purchased file is defective, incorrect, unavailable, or cannot be downloaded because of a technical issue, customers should contact Gilberto A Photos.

Depending on the circumstances, an appropriate resolution may include replacement of the file, restoration of download access, or a refund.

Nothing in this policy limits rights or remedies provided by applicable law.

7. Photographic Prints and Physical Products

Physical photographic products may be produced and fulfilled by independent professional printing laboratories, including WHCC or other selected providers.

Available sizes, materials, production methods, shipping destinations, and delivery costs depend on the product and fulfillment provider.

Prints may be produced specifically for each order.

Color and appearance may vary slightly depending on monitor calibration, printing materials, photographic paper, and production processes.

8. Shipping and Delivery

Shipping costs, available destinations, and estimated delivery times will be provided during checkout where applicable.

Delivery estimates are not guarantees.

Customers are responsible for providing a complete and accurate shipping address.

International orders may be subject to customs duties, import taxes, or other charges imposed by the destination country, unless otherwise stated at checkout.

9. Damaged, Defective, or Incorrect Physical Products

If a physical product arrives damaged, defective, or materially different from the order, customers should contact Gilberto A Photos as soon as reasonably possible.

Providing the order number and photographs of the affected product or packaging may help resolve the issue.

Depending on the circumstances and applicable law, an appropriate remedy may include a replacement, refund, or another suitable resolution.

Returns or exchanges for change of mind may be limited for customized or made-to-order products, subject to applicable consumer protection laws.

10. Copyright and Licensing

All photographs remain the intellectual property of Gilberto Alejandro González / Gilberto A Photos, unless otherwise indicated.

The purchase of a digital file, commercial license, or physical print does not transfer copyright ownership.

Small Digital, Medium Digital, and Large Digital downloads are licensed exclusively for personal, non-commercial use.

The Commercial License – Full Resolution product includes a limited, non-exclusive commercial license for the purchased photograph, subject to the applicable licensing conditions.

Commercial uses outside the scope of that license, including unauthorized resale, sublicensing, redistribution, or separate exploitation of the original image file, require additional written authorization.

11. Editorial and Commercial Licensing

Gilberto A Photos offers a standard non-exclusive commercial license through its online digital download system.

The Commercial License – Full Resolution option is available for $79.99 and includes the photograph at its maximum available resolution.

This license permits authorized editorial and commercial use for one project or campaign, according to the conditions published in the Copyright & Licensing policy.

Customers requiring broader permissions, multiple independent projects, exclusive rights, extended merchandising rights, sublicensing, or other specialized uses must contact Gilberto A Photos before proceeding.

Additional licensing arrangements, including customized Royalty-Free or Rights-Managed licenses, may be available upon request.

Licensing prices and conditions for these additional arrangements are determined individually according to the intended usage, distribution, territory, duration, and other relevant requirements.

Gilberto A Photos may update these Terms of Sale to reflect changes in products, fulfillment services, licensing conditions, payment procedures, or applicable requirements.

Updates will be published on this page with a revised date.

The version applicable to an accepted order will be the version in effect at the time of purchase, subject to applicable law.

14. Applicable Law

These Terms of Sale are intended to operate in accordance with applicable United States and Florida laws, without excluding mandatory consumer protections that may apply in the customer’s jurisdiction.

Any provision found unenforceable shall not affect the validity of the remaining provisions.
